On the 2nd, the National Assembly Election Petition Tribunal located in Makurdi, the capital of Benue State, dismissed Representative Emmanuel Udende of the All Progressives Congress (APC) from the Benue Northeast Senatorial Election and declared Representative Gabriel Suswam of the Peoples Democratic Party (PDP) as the elected candidate.
The panel chairman, Zik-Ikeorha and other members ruled in favor of the former governor, saying Suswam and the PDP had met the requirements of the law by proving irregularities such as mutilation, failure to sign documents and failure to vote legally.
Senator Udende's camp, while reacting to the defeat, wrote:
Udende's response, having been accepted and the necessary fees having been paid and the petitioners having responded, cannot be dismissed at this stage. Court decisions. The dismissal motion was revoked in favor of Senator Emmanuel Udende

The evidence provided by Suswam is completely insufficient to substantiate his claim.
Section 137 cannot be invoked in the case of Suswam's petition on the ground that his petition is non-compliant
He must pay 100,000 to Udende, APC and INEC
